Transcription from an original document - a lease by Sir Raphe Assheton to Edward Tetlow of forty acres of land and the buildings on it for 21 years at £34 per year signed by both parties on 18th April 1760. Mining woodcutting hunting and fishing rights remain with Sir Raphe as do rights to sell any manure produced, but he may use some to grow potatoes for his own family's use. Edward has also to keep a dog for Sir Raphe's use and to plant 5 trees (and make sure they grow) every year and must have his grain milled in Sir Raphe's Mill. In the last year only Edward can use the hay from the 'ffour acre' to feed his cattle.

He the said Edward Tetlow his Heirs Executors Administrators and Afigns or some of them yielding and paying therefore yearly and every year during the said term unto the said Sir Raphe Afsheton his Heirs and Assigns or to some of them the Clear Yearly Rent or Sum of thirty ffour pounds of good and lawful Money of great Britain at on or upon the Yearly ffeast Days of Pentecost and Saint Martin the Bishop in Winter by even and equal payments and also performing the Covenants and agreements hereinafter mentioned, and the said Edward Tetlow doth Covenant promise and Agree to and with the said Sir Raphe Afsheton his Heirs and Afigns that he the said Edward Tetlow his Heirs Executors Administrators and Afigns or some of them shal and will yearly and every year during the said term well and truly pay or Cause to be paid to the said Sir Raphe Afsheton his Heirs or Afigns or some of them the said Rent or Sum of Thirty ffour pounds of Current British Money at the Days and times and in such manner as is herein above mentioned and Appointed for payment thereof without any Deduction Defalcation or Abatement out of the same for or in Respect of any manner of Lays or Taxes or Gaulds Afefsments or other Charges whatsoever and also that he the said Edward Tetlow his Heirs Executors Administrators and Assigns shal and will not plow or any other way Break up any of the Meadow Ground hereby Demised during the said term nor above the Quantity or Compass of Six Acres of the other Ground in any one year during the said term of the Measure there Commonly Used in pain and fforfeiture to pay ffive pounds stirling an Acre for every Acre of the Meadow Ground and three pounds stirling an Acre for every Acre of the other Ground and so proportionably for a greater or Less Quantity and that to be paid as an Additional Rent (except for the better ditching or Guttering thereof) and Moreover that he the said Edward Tetlow his Heirs Executors Administrators and Afigns and every of them shal and will from time to time and at all times during the said term Make and Grind at the said Sir Raphe Afsheton's Mill called Middleton Mill all the Malt Corn and Grain which shal be Speut upon the hereby demised premises or which being of the Growth and product thereof or of any part thereof shal be Sold or otherwise disposed of in the fflour or Meal and shal and will pay the like Toll and Mulcture for the same as others of the said Sir Raphe Afsheton's Tenants within his Manor of Middleton usually pay at the same Mill and Moreover that the said Edward Tetlow his Heirs Executors Administrators and Afigns shal and will at his and their own proper Coft and Charges during all the said term hereby demised Bear pay and Discharge all Lays Taxes Assessments and likewise Serve all Offices both ordinary and extraordinary which shall be Layed Taxed Afsessed put Imposed upon or become due and payable for or in Respect of the hereby demised premises or any part thereof and also that he the said Edward Tetlow his Heirs Executors Administrators and Assigns shal and will upon his and their own proper Coft and Charges from time to time and at all times herein after when and as often as Need shal Require during the Continuance of this present demise or Lease and the term hereby granted well and sufficiently Repair Maintain Uphold and Keep all and every the Housing Buildings Hedges Ditches ffences waterbanks Gates Yates Styles Orchards Gardens and all other the premises with all Needful and Necefsary Reparations whatsoever and also at the end of the said term or sooner Determination of this present Demise and Lease shal and will peaceably and Timelly Leave Deliver Surrender and Yield up in good sufficient and Tenantable Repair and Order unto the said Sir Raphe Afsheton his Heirs or Assigns and ffurthermore that the he said Edward Tetlow his Heirs Executors Administrators and Afigns (ffor the Increase of Timber and wood upon the hereby demised tenement and premises shal and will yearly and every year during the said term plant and set ffive handsome plants or trees of Oak Ash Elm or poplar in some Apt or Convenient part of the premises and after the same are so set shal and will endeavour the preservation of the same trees to the best of his and their Skill and power or in Recompence there shal forfeit for every such tree not set and so preserved every year Two Shillings to be paid yearly at the Rent Days aforesaid and in Default of payment thereof the same to be Levyed by Diftrefs by the said Sir Raphe Afsheton his Heirs and Assigns as in Case of Nonpayment of Rent And also that the said Edward Tetlow his Heirs Executors Administrators and Assigns shal and will Keep a Hound or other Dog for the Use of the said Sir Raphe Afsheton and his Heirs when and as often as thereunto by him or them Required during the said term;
